ORDER

This writ petition has been filed seeking for a direction to the 2nd respondent to transfer the patta in the name of the petitioner for the property more fully disclosed in the prayer to the writ petition based on the petitioner's representations dated 29.12.2021 and 13.03.2024mwithin a time frame to be fixed by this Court.

According to the petitioner, she is the mother of the 3rd respondent. She had earlier executed a Settlement deed in favour of the 3rd respondent for the subject property. Subsequently, she cancelled the same. By virtue of the cancellation deed, the petitioner seeks for restoration of patta in her name. The petitioner had given representations on 20.12.2021 and 13.03.2024 for the aforesaid purpose. Since the same have not been considered, the petitioner has filed this writ petition.

Mr.S.Arumugam, learned Government Advocate, accepts notice on

behalf of respondents 1 and 2.

No prejudice would be caused to the respondents if the petitioner's representations, as stated above, are directed to be disposed of by the respondents, on merits and in accordance with law, after hearing the objections of the 3rd respondent and all other necessary parties, within a time frame to be fixed by this Court.

Since the Revenue Divisional Officer, Paramathi Vellore, Namakkal District, is the competent authority to adjudicate the petitioner's representations, this Court by exercising its suo-motu powers, impleads the Revenue Divisional Officer, Paramathi Vellore, Namakkal District as the 4th respondent in this writ petition. The Registry is directed to carry out the necessary amendment in the cause-title. Mr.S.Arumugam, learned Government Advocate, also undertakes to accepts notice on behalf of the newly impleaded 4th respondent.

This Court is not expressing any opinion on the merits of the petitioner's representations dated 29.12.2021 and 13.03.2024.

For the foregoing reasons, this Court directs the newly impleaded 4th respondent to pass final orders, on merits and in accordance with law, on the petitioner's representations dated 29.12.2021 and 13.03.2024 seeking for transfer of patta for the subject property more fully disclosed in the prayer to the writ petition, after giving due consideration to the supporting documents produced by the petitioner and after hearing the objections of the 3rd respondent and all other necessary parties, whom the 4th respondent deems fit to enquire within a period of twelve weeks from the date of receipt of a copy of this order.

8. This writ petition is disposed of with the aforesaid directions. No costs.
