When the above Appeal is taken up for hearing, learned counsel on either side submitted that the parties have settled the matter out of Court and also entered into a memorandum of compromise dated 08.10.2017 and in view of the same, the above Appeal may be disposed of in terms of the memorandum of compromise dated 08.10.2017. The learned counsel on either side also produced the Joint Memorandum of Compromise dated 08.10.2017.

2. In view of the submissions made by the learned counsel on either side, the Memorandum of Compromise dated 08.10.2017 produced by the learned counsel on either side is taken on record and the above Appeal is disposed of in terms of the Memorandum of Compromise dated 08.10.2017. The Memorandum of Compromise shall form part of the decree to be passed in the above Appeal. No costs. Connected miscellaneous petition is closed.
