Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondent to consider and pass orders on the petitioner's application dated 4.4.2017, for grant of renewal of permit for a period commencing from 21.4.2017 to 20.04.2022 in respect of route from Attibele Border to Thiruvannamalai, as per the Act 41 of 1992 Section 10 of Motor Vehicle Act, 1988.

O R D E R

The petitioner seeks for a mandamus directing the respondent to consider and pass orders on the petitioner's application dated 04.04.2017, wherein and whereby he sought for grant of renewal of permit for a period commencing from 21.04.2017 to 20.04.2022 in respect of route from Attibele Border to Thiruvannamalai.

2. Heard both sides.

3. It is seen that the petitioner is a stage carriage operator operating on the route from Attibele Border to Thiruvannamalai. It is stated that originally, a permit in respect of the route from Hosur to Dharmapuri (via) Krishnagiri was issued upto 20.04.1972 to one Sarojamma, who is the https://hcservices.ecourts.gov.in/hcservices/

petitioner's grandmother. It is also stated that the petitioner made an application before the respondent for renewal of permit from 21.04.1972 to 20.04.1977 and the said application is pending before the respondent. Again the petitioner made an application on 04.04.2017, for grant of renewal of permit for a period of 5 years commencing from 21.04.2017 to 20.04.2022.

4. The grievance of the petitioner before this Court is that the said application has not been considered by the respondent so far. This Court, at this stage, is not expressing any view on the claim made by the petitioner, as it is for the respondent to consider and decide the same. Accordingly, this writ petition is disposed of, only with a direction to the respondent to consider the application of the petitioner dated 04.04.2017, seeking for renewal of permit for a period commencing from 21.04.2017 to 20.04.2022 and pass orders on the same, on its own merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
