Civil Suit No. 744 of 2015 is filed praying to declare the notice dated 25.02.2015 issued by the 1st defendant to convene the 52nd Annual General Meeting of the Shareholders of the 1st defendant Company pertaining to the accounting year 2013-2014 on 09.09.2015 at Youth Hostel, Second Avenue, Indira Nagar, Chennai 600 020 at 9.45 am to transact the business mentioned in the said notice as ''invalid, null and void'' and to grant a permanent injunction restraining the defendants from conducting the Annual General Meeting on 09.09.2015 pertaining to the accounting year 2013-2014 at

youth Hostel, 2nd Avenue, Indira Nagar, Chennai 600 020 to transact the business mentioned in the said Notice pursuant to the notice dated 25.02.2015 issued by the 1st defendant and for costs of this suit.

Civil Suit No. 745 of 2015 is filed praying to declare the notice dated 14.02.2015 issued by the 1st defendant to convene the 51st Annual General Meeting of the Shareholders of the 1st defendant Company pertaining to the accounting year 2012-2013 on 09.09.2015 at Youth Hostel, Second Avenue, Indira Nagar, Chennai 600 020 at 9.00 am to transact the business mentioned in the said notice as ''invalid, null and void'' and to grant a permanent injunction restraining the defendants from conducting the Annual General Meeting on 09.09.2015 pertaining to the accounting year 2012-2013 at youth Hostel, 2nd Avenue, Indira Nagar, Chennai 600 020 to transact the business mentioned in the said Notice pursuant to the notice dated 14.02.2015 issued by the 1st defendant and for costs of this suit.

JUDGMENT

The learned counsel appearing for the plaintiff in both the suits submit that the plaintiff has instructed him to withdraw both the suits. He has also made and endorsement to that effect.

2. Considering the submission made by the learned counsel for

the plaintiff and in view of the endorsement made, both the Suits are dismissed as withdrawn. Accordingly, the connected Original Application Nos. 986 and 987 of 2015 are closed. No costs. 09.10.2015 rms
