ORDER

This criminal original petition has been filed to direct the 1st and 2nd respondents to investigate and file final report in Crime No.323 of 2013, pending on the file of 2nd respondent.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. The learned Additional Public Prosecutor has filed a counter, wherein, in para - 6, it is stated as follows; "6. I submit that based on the report of Special Team and statements of witnesses, I came to know that the above said accidental vehicle's registration No. not known by the complainant and others, hence the said accidental vehicle not traced out. Hence, the case was referred as "UNDETECTED" by Tr. Murugachalam, the then Inspector of Police on 31.10.2014 and the R.C.S No.17/2014, dated 31.10.2014 served to the petitioner/complainant. Then, the final report https://hcservices.ecourts.gov.in/hcservices/

(R.C.S.No.17/2014) was submitted before the Learned Judicial Magistrate Court No.II, Pollachi."

In view of the above, liberty is given to the petitioner to approach the learned Judicial Magistrate No.II, Pollachi, for filing protest application, in the event of the learned Judicial Magistrate No.II, Pollachi, not having accepted the final report. With the above observation, the criminal original petition is closed.
