O R D E R

This Criminal Original Petition has been filed to quash the Summons, dated 21/4/2022, issued by the first respondent Police to the petitioner.

2. Heard Mr.S.S.Karthikeyan, learned counsel for the petitioner, Mr.A.Gokulakrishnan, learned Additional Public Prosecutor for the first respondent and Mr.C.Emalias, learned counsel for the second respondent.

3. The allegation in the First Information Report is that the petitioner/accused has cheated a huge amount of Rs.17 crores and she has opened 24 shell Companies and money has been transferred to the shell companies.

4. It is the contention of the learned counsel for the petitioner that several summons have already issued. She has already given statement about the loan advanced by Lakshya Enterprises, interest and principal amounts repaid by them along with the documentary proofs.. Therefore, the present summon dated 21/4/2012 has to be quashed.

5. At the outset, this Court is unable to agree with the argument advanced by the learned counsel for the petitioner. When huge details are required to be unearthed, the petitioner cannot set any deadline for the Investigation Officer and contend that he cannot appear before the Investigation Officer. It is the duty of the petitioner to appear before the Investigation Officer to give necessary particulars as required by the Investigation Officer. The Investigation Officer shall conduct investigation with the petitioner and complete the investigation, within a period of one week, if the petitioner appears for investigation.
