This application has been filed seeking to condone the delay of 49 days in filing the written statement by the 4th defendant. 2.In the affidavit filed in support of the Judges Summons, it had been stated that after receiving the suit summons, documents had to be searched to forward instruction to the learned counsel for preparing the written statement. The documents were obtained only after due search and in the meanwhile, the time for filing the written statement had expired. 3.Heard the learned counsel for the plaintiff also. 4.Taking a overall view of the entire issue, the delay stands condoned and the written statement of the 4th respondent is taken on file. This application stands allowed.
