Writ Petition filed under Article 226 of the Constitution of India for the issuance of writ of Mandamus directing the respondents to include the name of the petitioner in the panel drawn for the year 2015 by taking the crucial date for promotion as 01.01.2015 in the appropriate place and to give promotion to the petitioner to the post of B.T Assistant (English) with all consequential benefits and pass further suitable orders. Mr.V.Jayaprakash Narayanan, learned Special Government Pleader takes notice for the respondents.

2.The petitioner joined as a Secondary Grade Teacher in the year 2005 in Kalasapakkam Panchayat Union, Thiruvannamalai District. He passed B.Ed degree in December 2014. The petitioner was granted one set of incentive increment for having passed B.A., B.Ed decree with effect from 11.12.2014.

3.The grievance of the petitioner is that, when a panel for promotion to the post of B.T Assistant was drawn by the respondents for the year 2015, the name of the petitioner was not included in the same. According to the petitioner, the crucial date is 01.01.2015. Since he was granted incentive increment w.e.f 11.12.2014, as on 01.01.2015, he was in possession of B.Ed., degree hence, according to him, he is eligible for promotion to the post of B.T Assistant as on 01.01.2015.

4.The respondents proceeded, as if, the petitioner was not qualified for getting included in the panel for promotion for the year 2015 to the post of B.T Assistant. In this regard, the petitioner made a representation dated 20.05.2015 to the first respondent through proper channel however, the same has not been considered by the respondents so far.

5.In these circumstances, the first respondent is directed to consider the representation of the petitioner dated 20.05.2015, in the light of the aforesaid facts and pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
