This Criminal Original Petition has been filed to register complaint of the petitioner dated 24.04.2011 sent through e-mail to the respondent against Mr.Venkata Subramanian, enquire him and initiate appropriate proceedings.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. On a reading of the complaint dated 24.04.2011, it appears that the partition dispute is between the petitioner and his brother and the petitioner's brother has sent some SMS, which are disparage in nature.

4. In view of the above, this court cannot direct the respondent police to register a case in this nature and it is always open to the petitioner to file a private complaint against his brother. Hence, the criminal original petition is closed.
