O R D E R

This Criminal Original Petition has been filed praying to direct the second respondent police to execute the Non-Bailable Warrant issued against the 1st respondent in S.T.C No.4155 of 2008 on the file of the learned Judicial Magistrate, Ootacamund, The Nilgiris.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the first respondent.

3. It is seen that the Trial Court had issued warrant for apprehension of first respondent/accused in the year 2008 in S.T.C.No.4155 of 2008.

4. The learned Additional Public Prosecutor on instructions from the second respondent Police submits that the said warrant is not available with the respondent Police. Under such circumstances, the petitioner shall apply for a fresh Non-Bailable Warrant from the concerned Court addressed to the second respondent Police and the second respondent Police is directed to execute the same expeditiously.

5. With the above direction, this Criminal Original Petition is closed.
