O R D E R

The petitioner has come forward with the present petition seeking for a direction to the learned Judicial Magistrate, Ooty, The Nilgiris to dispose of the complaint in C.C.No.58 of 2011 within the stipulated time as may be fixed by this Court.

2. An explanation has been received from the learned Judicial Magistrate, Udhagamandalam which states that the matter was inadvertently posted for defence side evidence on 28.05.2015 and thereafter, adjourned from time to time and posted to 21.09.2015. It was further stated that till date neither party represented before the Court that the case had been wrongly adjudicated as defence side evidence, though the case is at argument stage. But on scrutinizing the case records, it was found that the case is at the stage of argument.

3. Considering the above stated circumstances and the fact that the accused is appearing before the Court, the learned Judicial Magistrate, Udhagamandalam is directed to dispose of C.C.No.58 of 2011 within a period of three months from the date of receipt of a copy of this order. 4. The Criminal Original Petition is disposed of with the above direction.
