Heard learned counsel for the petitioner.

2.Learned counsel for the petitioner would submit that when the matter was posted on 18.03.2026 before II Additional District Munsif Court, Kallakurichi, for filing written statement by the petitioner (wife) herein, she was set exparte for her non appearance. He would further state that the matter is posted today for exparte evidence and adjourned to 16.04.2026. 3.The petitioner herein is set exparte in the Original Suit in O.S.No.227 __________ https://www.mhc.tn.gov.in/judis

kas of 2025 and at this stage, petitioner seeks to transfer the case to the Family Court, Nagapattinam. In such circumstances, the petitioner may take out relevant application before the trial Court and after disposal of the said application, she is at liberty to move Transfer Civil Miscellaneous Petition afresh.

4.With the above said observation, this Transfer Civil Miscellaneous Petition stands dismissed. No costs. Consequently, the connected C.M.P.No.8458 of 2026 is closed.
