O.A.No.402 of 2019 in C.S.No.447 of 2013 R.SUBRAMANIAN.J., This original application has been filed seeking an order of ad-interim injunction restraining the 3rd respondent/3rd defendant from putting up any construction in the suit property.
2. Admittedly, the 3rd respondent purchased the suit property from the 2nd respondent on 13.06.2018. The 3rd respondent has filed a counter stating that after the purchase she has demolished the existing construction put up in the suit property and after obtaining necessary permission, she started construction over the vacant land and now the construction work has almost been completed.
3. In view of the above, I do not find any justification in the injunction application and hence the same is dismissed with an observation that any construction put up by the 3rd respondent is subject to the result of the pending testamentary original suit.
