JUDGMENT
It is manifested from the records that when the Civil Miscellaneous Appeal was taken up for hearing on 04.07.2016, there was no representation on behalf of the appellant. Hence, the matter was directed to be listed on 05.07.2016. Even on 05.07.2016 as well as on 11.07.2016, there was no representation on behalf of the appellant. It is also to be noted that when the appeal came up for hearing on 29.06.2016 under the caption "for orders", there was also no representation for the appellant. https://hcservices.ecourts.gov.in/hcservices/
2. Under this stand, it is presumed that the appellant does not have any interest in prosecuting the appeal and therefore this Court finds that it may be better to dismiss this appeal instead of keeping it alive for want of prosecution.
3. In view of the above fact, this Civil Miscellaneous Appeal is dismissed for non prosecution. However, there shall be no order as to costs.
