ORDER

C.M.P.No.8127 of 2023 is filed to condone the delay of 5179 days in filing the petition to set aside the abatement caused due to the death of 1st respondent in S.A.No.126 of 2008 namely A.K.Mohammed Batcha.

C.M.P.No.8128 of 2023 is filed to set aside the abatement caused due to the death of 1st

respondent in S.A.No.126 of 2008 namely A.K.Mohammed Batcha. C.M.P.No.8130 of 2023 is filed to bring on record the proposed respondents 3 to 5 herein namely a)Chand Begum (Daughter), b) Kather Basha (Son) c) Thara Begum (Daughter) as the legal heir of the late 1st respondent and rank them as the respondents 3 to 5 in S.A.No.126 of 2008.

Heard both sides.

Learned counsel appearing for the respondents 3 to 5 has not raised any serious objection in allowing these petitions.

Being satisfied with the reasons stated in these affidavits filed in support of these petitions, the Civil Miscellaneous Petitions are ordered and the delay is condoned. Registry is directed to carry out the necessary amendments and list the main Second Appeal on 10.02.2025.
