Crl.O.P.No.15364 of 2016 S.VAIDYANATHAN, J.

The petitioners, who were arrested and remanded to judicial custody on 13.06.2016 for an alleged offences punishable under Sections 306 IPC in Crime No.91 of 2016 on the file of the respondent police, seeks bail.

2. This Court is unable to think where the society is going towards and the values and cultures are running down and vanishing because of the incidents like this, which are narrated below.

3. This is a case where the husband of the second petitioner committed suicide. It is a case under section 174 Cr.P.C. and thereafter, altered into section 306 IPC in Crime No.91 of 2016 and the petitioners were remanded to judicial custody.

4. Out of the wed lock between the second petitioner and the deceased, they have got a male child. On account of lust developed towards the brother of the deceased, the wife of the deceased and the brother of the deceased started having illicit relationship, which came to the light of the deceased and the deceased leaving behind a suicide note, committed suicide.

5. Now the second petitioner is trying to shed crocodile tears, that she is having a child to take care of.

The suicide note reveals that there was illicit relationship between the petitioners and of course, it has got to be investigated in detail by the Investigating Officer. Whether the ingredients of Section 306 and 107 are attracted or not, is a matter for investigation and it can be brought to light in the course of trial.

6. Taking note of the fact that the second petitioner and the brother of the deceased, who is the first petitioner herein, had illicit relationship, this Court is not inclined to grant the relief sought by the petitioner and the petition is dismissed.
