This application has been filed by the applicant/ 3rd defendant to set aside the ex-parte order dated 05.04.2022 passed in the above suit.
2. The learned Counsel for the applicant has also filed an adoption memo stating that the applicant/3rd defendant adopts the written statement filed by the 6th defendant in the above suit and the same is recorded.
3. The reasons stated in the accompanying affidavit for the reliefs sought for in this application are satisfied and also considering the fact that the respondents have not raised any objections, this application is allowed and the ex-parte order passed by this Court 05.04.2022 is set aside.
4. Since, issues were already framed on 05.04.2022, Registry is directed to place the matter before the Master for recording evidence and list the matter before this Court after recording evidence.
5. The Master is directed to submit the report along with the depositions and documents marked, if any.
