ORDER

The present transfer petition has been filed by the petitioner/husband seeking transfer of I.D.O.P.307 of 2024 pending on the file of the Principal District and Sessions Judge, Thiruvallur, to the Page No.1 of 4

Principal Family Court, Chennai.

2. Learned counsel for the petitioner submitted that the petitioner is employed at Madhavaram and resides at Thirumullaivoyal, and therefore it would be difficult for him to travel nearly 50 km to attend the hearings before the learned Principal District and Sessions Judge, Thiruvallur. Hence, he seeks that the transfer petition be allowed as prayed for.

3. Per contra, learned counsel for the respondent/wife submitted that the respondent is presently employed in the United Kingdom and that the wife is being represented by her father, who resides at Ayappakkam, Chennai - 77. The learned counsel, in principle, has no objection to the transfer from the Court of the Principal District and Sessions Judge, Thiruvallur. However, he suggested that the case may be transferred to the II Additional District Court, Poonamallee, since it would be more convenient both for the petitioner as well as for the respondent's father, who resides closer to Poonamallee than to the Family Court, Chennai.

In view of the above, this Transfer Civil Miscellaneous Petition is partly allowed and the case in I.D.O.P.307 of 2024 is withdrawn from the file of the Principal District and Sessions Judge, Thiruvallur and transferred to the file of the II Additional District Court, Poonamallee, instead of Principal Family Court, Chennai.
