The petitioner was an Executive Engineer. He attained the age of superannuation on 31.01.2014, but he was not permitted to retire. At the time when he reached the age of superannuation, a criminal case was pending against him. The criminal case ended in acquittal. However, the disciplinary proceedings initiated against the petitioner is pending.
2. According to the petitioner, the order retaining him in service states that the headquarters of the petitioner will be at Minparai (Attakkati) in Valapari Taluk, Coimbatore District. The grievance of the petitioner is that he is a resident of Udumalpet Town and he finds it difficult to meet his needs in the present headquarters. It is also his case that no prejudice would be caused, if the headquarters is shifted to Udumalpet from the https://hcservices.ecourts.gov.in/hcservices/
present Headquarters at Minparai (Attakkati). In this regard, the petitioner submitted a representation dated 08.06.2015. The learned counsel would submit that enquiry is completed, however, no final order is passed. Hence, the petitioner has come up with the present writ petition.
3. In fact, I am of the view that no prejudice would be caused in permitting the petitioner to have the headquarters at Udumalpet Town, particularly, when the said place is also nearer to the present Headquarters, where the enquiry took place and more particularly when the enquiry is completed.
4. In these circumstances, a direction is issued to the respondents to pass appropriate orders on the representation of the petitioner, dated 08.06.2015 in the light of the facts set out above, within a period of three weeks from the date of receipt of a copy of this order.
The writ petition is disposed of accordingly. No costs. Sd/- Assistant Registrar(CO) //True Copy// Sub Assistant Registrar svki To The Chairman cum Managing Director, Tamil Nadu Generation and Distribution Corporation Limited, 144, Anna Salai, Chennai - 600 002.
