This Criminal Original Petition has been filed seeking a direction to cancel the Anticipatory Bail granted to the 2nd Respondent/Accused-Arul Thamarai, in Crl.O.P.No.3009 of 2017, dated 31.08.2017.

2. Heard the learned counsel for the petitioner, the learned Government Advocate appearing for the 1st respondent and perused the materials placed on record.

3. Arul Thamarai, who is an accused in DCB Crime No.11 of 2016 filed Crl.O.P.No.3009 of 2017 under Section 438 Cr.P.C. seeking anticipatory bail. This Court, by detailed order dated 31.08.2017 in Crl.O.P.No.3009 of 2017 granted anticipatory bail to Arul Thamarai on certain conditions, one of which is that she https://hcservices.ecourts.gov.in/hcservices/

should surrender before the Judicial Magistrate No.I, Thiruvannamalai, within a period of six weeks and execute a bound for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties and that she should also deposit of Rs.4,00,000/- (Rupees Four Lakhs only). Since Arul Thamarai has not complied with the order till date, this application has been filed by the de facto complainant for cancellation of Anticipatory Bail.

4. Heard the learned counsel for the de facto complainant. Notice has been served on Arul Thamarai and she has entered appearance. Counsel for Arul Thamarai submitted that Arul Thamarai had not complied with the conditions imposed by this Court and has not even executed the bond.

5. In such view of the matter this petition is allowed and the Anticipatory Bail that was granted to Arul Thamarai in Crl.O.P.No.3009 of 2017 dated 31.08.2017 stands cancelled. Sd/- Assistant Registrar(CCC) //True Copy// Sub Assistant Registrar gmd To
