The petitioner, who is an accused in Crime No.47 of 2015, has filed this quash petition.
2. The learned Additional Public Prosecutor submitted that investigation in this case completed and the petitioner has been dropped as accused. Now A3/Jayaprakash alone arrayed is accused in this case which culminated in to calender case pending on the file of the Judicial Magistrate -VII, Coimbatore. On 21.09.2020, while filing charge sheet notice was issued to the second respondent/defacto complainant for deletion of accused and alteration of Section between FIR and charge sheet.
3. In view of the submissions made by the learned Additional Public Prosecutor, and the petitioner is no more accused in Crime NO.47 of 2015, nothing survives in this Petition for further adjudication. Accordingly, the present Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed.
