Respondent This petition is filed under Section 24 of C.P.C. to withdraw H.M.O.P.No.321 of 2014 on the file of the Subordinate Judge, Poonthamallee and transfer the same to any Court having competent jurisdiction in Kumbakonam and try along with M.C.No.1 of 2014 on the file of Magistrate Court, Kumbakonam or any other court having competent jurisdiction.

ORDER

The wife has come before this Court seeking transfer of H.M.O.P.No.321 of 2014 on the file of the Subordinate Judge, Poonthamallee filed by the respondent/husband for divorce to the file of Judicial Magistrate, Kumbakonam, where M.C.No.1 of 2014 is pending.

Heard the learned counsel on both parties. Since the wife is residing along with her parents in Kumbakonam and it is impossible for her to travel 275 kilometre for every hearing and therefore, it is appropriate to transfer H.M.O.P.No.321 of 2014 pending on the file of Sub Court, Poonthamallee. Similarly, M.C.No.1 of 2014 pending before the Judicial Magistrate, Kumbakonam is also transferred to the file of Family Court, Nagapattinam to be tried together. 3.

Hence, H.M.O.P.No.321 of 2014 pending on the file of Sub Court, Poonthamallee and M.C.No.1 of 2014 pending on the file of Judicial Magistrate, Kumbakonam are withdrawn and transferred to the file of Family Court, Nagapattinam. petition is ordered. No costs. Consequently the connected M.P.No.1 of 2014 is closed.
