ORDER

The Writ Petition has been filed by the petitioner seeking a direction to the respondents to consider the petitioner's representations dated 06.08.2025, consequently direct the respondents to issue a non traceable certificate.

2.The petitioner had sent a representation dated 06.08.2025 seeking the respondents to issue a Non Traceable Certificate, but no action has been taken. Hence, the present writ petition.

3.The contention of the learned counsel for petitioner is that the petitioner purchased the property in S.Nos.187/6C, 187/6D in Podavur Village, Sriperumbudur Taluk admeasuring 13.82 cents from Anubhava Green Farms and Resorts Pvt. Ltd, registered on the file of SRO, Sriperumbudur vide Doc.No.5779/1994. On 08.07.2025, the petitioner went to Xerox shop to take copies of the document and the same was lost. Thereafter, he lodged a complaint to the respondent on 06.08.2025 along with supporting documents. In fact, public notice issued in daily papers and submitted an affidavit to the respondent. Though CSR No.1127 of 2025 assigned, thereafter no action has been taken.

4.The learned Government Advocate (Crl. Side) submitted that the petitioner was called to produce the documents and to cause publication in the dailies and file an affidavit following the circular of Director General of Police, Head of Police Force, Chennai in R.C.No.2029209/General.1(1)/2022, dated 01.04.2022. The DGP circular issued certain guidelines in issuing NonTraceable Certificate in respect of the missing documents. If the petitioner complies with the DGP circular, on satisfaction, if found to be correct, thereafter Non Traceable Certificate can be issued.

5.This Court considered the rival submissions and perused the materials available on record.

6.A scanned reproduction of Circular issued by the Director General of Police, Head of Police Force, Chennai, dated 01.04.2022 and documents required to issue Non Traceable Certificate, are as follows:-

The respondent Police to follow the above circular for issuance of Non Traceable certificate, but the only concern is that citing the same, causing harassment by not entertaining the complaint of a person who lost the document and making him to run from pillar to post, is not proper. So that unnecessarily the public are not harassed and made to feel that they are harassed for some other reason.

8.In view of the same, the petitioner to appear before the respondent and to produce the relevant documents. On his appearance, the respondent Police following the said circular take appropriate steps and issue Non Traceable Certificate without any delay. In any event, the entire exercise to be completed within a period of three months from the date of receipt of a copy of this order. 9.It is reminded that Anubhava Green Farms and Resorts Pvt. Ltd. had some criminal cases and several orders were passed by this Court. This factum also to be considered before issuance of Non Traceable Certificate. 10.With the above directions, the Writ Petition is disposed of. 16-04-2026 Index: Yes/No Speaking/Non-speaking order RSI
