The petitioners, who are accused in Crime No. 351 of 2025 on the file of the 1st respondent Police registered for the offences under Sections 296(b), 115(2) and 79 of BNS Act, 2023 based on the complaint lodged by the 2nd respondent have come forward with the present quash petition. 2.
The contention of the petitioners is that a false case has been given by the 2nd respondent/de facto complainant stating that as though the petitioners were creating nuisance and also threatening the de facto complainant's wife and assaulted her. In fact, it is the 2nd respondent, who had attempted to assault the petitioners and a case in Crime No. 352 of 2025 has been registered against the 2nd respondent and his wife. It is further submitted that a private complaint in Crime No. 619 of 2021 was registered as against the petitioners as though the petitioners had collected money on the false promise of securing a job and since the petitioners approached this Court and obtained stay, enraged over the same, a false complaint has been lodged against the petitioners.

Learned Additional Public Prosecutor appearing for the 1st respondent would submit that it is a matter of case and counter. The 2\4
petitioners are accused in Crime No. 351 of 2025 which came to be registered based on the complaint by the de facto complainant and the petitioners have lodged a complaint against the de facto complainant and others, which is pending in Crime No. 352 of 2025. Both the cases are being investigated jointly following the judgment of the Full Bench of this Court in T. Balaji and Another V. State rep. by The Inspector of Police, Chennai reported in (2024(2) LW (Crl.) 175) and Police Standing Order (PSO) 566. 4.
Recording the above submission of the learned Additional Public Prosecutor, the criminal original petition is disposed of with a direction that the final report shall be filed, more preferably, within a period of 3 months from the date of receipt of a copy of this order. Connected miscellaneous petition is closed.
