This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus calling for records of the respondent dated 25.03.2022 in Na.Ka.N.13250/06/B6/Che and quash the same and consequently forbear the respondent from any manner selecting a Managing Committee to the Bachewali Mosque Wakf at No.13, Old No.6, Papanasam Sivan Salai, Mylapore, Chennai except by conducting elections by secret ballot in compliance to order in O.A.No.2/2010 on the file of the Wakf Tribunal Chennai.
2.The learned counsel appearing for the petitioner submitted that the respondent issued impugned letter inviting a list of 44 persons to appear before the Board for selection and appointment of Managing Committee to the Bachewali Mosque Wakf at No.13, Old No.6, Papanasam Sivan Salai, Mylapore, Chennai, which is not in terms of Scheme decree and recognized bye - law and further submitted that for appointment of Managing Committee, election has to be conducted strictly in terms of the Scheme decree and recognized bye law. 3.The learned counsel appearing for the respondent submitted that election for the Managing Committee to the Bachewali Mosque 2/4
Wakf at No.13, Old No.6, Papanasam Sivan Salai, Mylapore, Chennai, was conducted strictly in terms of the Scheme decree recorded by the competent forum.
4.Recording the submission of the learned counsel appearing for the respondent, this writ petition is disposed of. No costs.
