ORDER

This petition has been filed seeking a direction to the fourth respondent to investigate the complaint and take action against the accused persons and to give protection to the petitioner and his family members based on the complaint dated 27.02.2026 and to remove the wire fencing and boundary stones allegedly laid on the petitioner land.

2. According to the petitioner, the petitioner's father was the absolute owner of the subject property and he had settled the same to him by way of a Will. The said Will was duly probated in OS.No.364 of 1991 by judgment dated 08.12.1995 and the same has been registered in Document No.3321 of 2017. While so, one Madhivanan, claiming to have purchased the property and holding a sale certificate, is attempting to encroach the property based on false claims. Hence, the petitioner submitted a representation on 27.02.2026, however, no action has been taken.

3. The learned Additional Public Prosecutor submitted that prior to the said representation, the petitioner had sent an earlier representation to the DGP's office on 12.01.2026. The said representation was forwarded to the fourth

respondent and the fourth respondent had called both the parties. Both the petitioner and the respondents 5 and 6 appeared on 27.02.2026 and undertook to produce supporting documents. Thereafter, they have not appeared and the enquiry is still pending. The present petition is repetition of the earlier representation dated 12.01.2026.

4. The learned counsel for the petitioner submitted that the petitioner undertakes to appear before the fourth respondent on 09.04.2026 along with all relevant supporting documents.

5. In view of the above submissions, the petitioner is directed to appear before the fourth respondent on 09.04.2026 along with supporting documents. The fourth respondent is directed to summon the respondents 5 and 6, cause enquiry and dispose of the petitioner's complaint dated 27.02.2026 along with earlier complaint dated 12.01.2026. Upon enquiry, if any encroachment is found, the same shall be removed in the manner known to law.
