Writ Petition filed under Article 226 of the Constitution of India for the relief of issuance of Writ of Mandamus directing the 1st respondent to pass orders on the revision petition filed by the petitioner dated 25.06.2015 with consequential benefits including promotion to the post of Manager based on 2014 panel, within a time frame to be fixed by this court.

ORDER

The petitioner is working as a Field Manager at Krishnagiri Field Office under the control of the 2nd respondent. While so, on 03.02.2014 he was issued with a charge memo by the 2nd respondent stating that he failed to discharge his duty and there was lack of supervision on his part. According to the petitioner, he submitted a detailed explanation to the charge memo. Thereafter, an enquiry officer was appointed and an enquiry was conducted. Ultimately, he was imposed with a penalty of censure by the 2nd respondent by his order dated 06.06.2015. Aggrieved by the said order, the petitioner filed a revision under Section 153 of The Tamil Nadu Cooperative Societies Act on 25.06.2015 before the respondent and the same is pending.

2. I have heard Mr.G.Sankaran, the learned counsel for the petitioner and Mr.D.Venkatachalam, the learned Government Advocate, who takes notice for the 1st respondent. No notice is ordered to the 2nd respondent as this order will not in any manner be prejudicial to the interest of the 2nd respondent.

3. The learned counsel for the petitioner would submit that the prescribed court-fee has not been paid by the petitioner and hence, the revision could not be numbered. He would fairly submit that if the defects are complied with, the revision petition would be taken on file and disposed of within a reasonable time to be fixed by this court.

4. At this juncture, the learned counsel for the petitioner would submit that the petitioner is prepared to rectify the defect and pay the deficit court fee, if any, today itself. The said statement is recorded.

5. Considering the limited scope of the prayer sought for by the petitioner and having regard to the above submissions made on either side, this court directs the 1st respondent to dispose of the revision petition dated 25.06.2015 filed by the petitioner as against the order of censure imposed by the 2nd respondent, on rectification of the defects by the petitioner, within a period of three weeks from the date of rectification of the defects as pointed out by the concerned authority. No costs. Consequently, connected MP is closed.
