ORDER

The present petition has been preferred by the petitioner seeking direction to the respondent to file the final report in crime no.1352 of 2015. 2.It is the contention of the learned counsel for the petitioner that the petitioner has lodged a complaint before the respondent police against one Mr.Raja and his father Mr.Ramasamy for the alleged offences under section 420 IPC in crime no.1352 of 2015 and even after registration of the complaint, the respondent has not taken proper steps to conduct and conclude the investigation and therefore, the petitioner has filed Crl.O.P.No.1579 of 2017 before this court for a direction to the respondent police to complete the investigation and to file the final report. The said petition came to be disposed of vide order dated 13.02.2017 granting six weeks time to the respondent to file the final report. Even thereafter, as no progress has happened in the investigation, the present petition is filed.

3.Pursuant to the order made by this Court in the present petition on 26.03.2026, today, the learned Additional Public Prosecutor has produced the status report filed by the Deputy Commissioner of Police, Mylapore Range before this court. From the status report, it is seen that the Inspector of Police has examined the defacto complainant and the other witnesses and recorded their statements. Is is further stated that accused nos.1 and 2 in this case are still 2/4

absconding. After completion of the detailed investigation, on 29.10.2020, the Inspector of Police has filed the absconding charge sheet against accused nos.1 and 2 before the XVIII Metropolitan Magistrate, Saidapet through efiling and the same is yet to be taken on file.

4.This Court has heard the submissions made by both sides and perused the status report filed by the Deputy Commissioner of Police. This court is of the view that the respondent police had conducted the investigation in this case and examined the witnesses and recorded their statements. As the accused persons are absconding, the absconding charge sheet has been filed before the concerned court. In the light of the above, recording the status report, this criminal original petition is dismissed.
