O R D E R

This Criminal Original Petition has been filed praying for a direction to the 2nd respondent to register an FIR on the complaint of the petitioner dated 09.06.2015 and investigate the same in accordance with law.

2. Heard Ms.R.Aparna, learned counsel for the petitioner and Mr.C.Emalias, learned Additional Public Prosecutor appearing for the respondents.

3. On a reading of the complaint dated 09.06.2015, it is seen that the petitioner had entered into a sale agreement with the opposite party on 24.07.2014, whereby the opposite party agreed to purchase the petitioner's land for a sum of Rs.57 lakhs. https://hcservices.ecourts.gov.in/hcservices/

Thereafter, it is alleged by the petitioner that the opposite party is not paying a sum of Rs.57 lakhs. In connection with that the petitioner gave a complaint, in which petition enquiry was conducted in C.S.R.No.937 of 2014.

4. On a reading of the complaint, it does not disclose the commission of any cognizable offence. The learned counsel for the petitioner submitted that the petitioner's land has been illegally sold by the opposite party subsequently. If so, liberty is given to the petitioner to give a fresh complaint to the respondent with all the details and on such complaint is being given, the same shall be enquired into and take action in accordance with law.
