ORDER
The petition has been filed to quash the impugned order dated 24.01.2022 in A.Thi.Mu.No. 3271/ AA3/ 2021 on the file of the 3rd respondent, and to direct the respondents 1 to 4 to accord approval to the appointment of the petitioner working as Office Assistant in the 5th respondent from 1.07.2021 with all monetary and other service benefits.

A mere perusal of the impugned order clearly indicate the fact that though the petitioner's application has to be considered by the fourth respondent, the impugned order was passed by the third respondent instead of forwarding the same to the fourth respondent. Therefore, the third respondent rejecting the application of the petitioner is per se arbitrary and that too, the order was passed without conducting an enquiry and without affording a
personal opportunity to the petitioner.
3.In these circumstances, this Court finds that the impugned order has to be necessarily quashed and therefore, it is quashed. Therefore, the matter is remitted back to the fourth respondent for a fresh consideration. It is informed that the approval petition of the petitioner is still with the third respondent. Therefore, the third respondent is directed to forward the petitioner's application along with the other relevant documents to the fourth respondent within a period of two weeks from the date of receipt of a copy of this order and the fourth respondent is directed to consider the same and pass orders on merits within a period of four weeks therefrom by following due process of law. With the above directions, this writ petition is allowed. Consequently, connected miscellaneous petitions stand closed. No costs. 05-03-2026 Index: Yes/No Speaking/Non-speaking order ssa
