Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a writ of mandamus, directing the first respondent / Revenue Divisional Officer, Pollachi, to decide the petitioner's Appeal Petition dt.29.07.2019 and pass orders therein after furnishing the copies of the statement and documents if any submitted by the 3rd respondent to the petitioner within the time stipulated by this Court. ORDER

This writ petition has been filed for the issue of writ of mandamus directing the first respondent to dispose of the appeal filed by the petitioner on 29.07.2019 within the time limit stipulated by this Court.

2. The case of the petitioner is that the second respondent had cancelled the patta in the name of the petitioner and the patta was transferred in the name of the third respondent. Aggrieved by the same, the petitioner filed the appeal before https://hcservices.ecourts.gov.in/hcservices/

the first respondent on 29.07.2019. It is the further case of the petitioner that the first respondent has also issued a notice and statement has also been recorded. The grievance of the petitioner is that till date no orders have been passed in the appeal filed by the petitioner. Therefore, the present writ petition has been filed seeking for appropriate directions.

3. Heard Mr.K.Premkumar, learned counsel appearing for the petitioner and Mr.E.Balamurugan, learned Special Government Pleader appearing for the respondents 1 and 2.

4. Taking into consideration, the facts and circumstances of the case and the limited relief that has been sought for in the writ petition, there shall be a direction to the first respondent to dispose of the appeal filed by the petitioner on 29.07.2019 strictly in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. The first respondent shall issue notice to the third respondent and give him opportunity before passing final orders in the appeal. The petitioner is directed to make a fresh representation to the first respondent along with the copy of the appeal and a copy of this order.

5. This writ petition is disposed of with the above directions. No costs.
