ORDER
The petition has been filed to direct the respondent to settle the retirement benefits of the petitioner including salary for the period of suspension from 05.08.2024 to 22.10.2024, surrender of earned leave, contribution to the Special Provident fund, Death-cum-retirement gratuity, leave salary for 19 days already
sanctioned, within a limited time frame.
2. The petitioner having been allowed to retire from service and in the absence of any adverse orders in respect of the pending departmental proceedings, the respondents had not disbursed the above benefits to the petitioner.
3. Aggrieved by the same, the petitioner made a representation to settle the retirement benefits including salary for period of suspension, surrender of earned leave, contribution to the Special Provident fund, Death-cum-retirement gratuity, leave salary for 19 days already sanctioned, for which there is no response till date. Therefore, the petitioner is before this Court.
4. Heard the learned counsel on either side and perused the materials available on record.
5. Admittedly, the terminal benefits has not been paid to the petitioner. Therefore, the Writ petition is disposed of and a mandamus is issued directing the respondent to disburse the retirement benefits including contribution to the Special Provident fund, Death-cum-retirement gratuity as per the extant rules and the benefits of salary for the suspension period, benefit of encashment of earned leave and leave on private affairs and leave salary for 19 days already
sanctioned, shall be paid as per the G.O.Ms.No.47, Human Resources Management (FR-III) Department, dated 29.08.2025, within a period of two (2) months from the date of receipt of a copy of this order.
