ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.02.2026 for the alleged offences under Sections 8(C) r/w 22(b), 25 and 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.11 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 02.02.2026, based on secret information, the respondent police intercepted the petitioner and seized 100 Nitrazepam tablets. Hence, the case was registered.

3. The learned counsel appearing for the petitioner would submit that this is a case of possession of 100 tablets of Nitrazepam and according to the prosecution, it is only intermediate quantity and the petitioner is innocent person. The learned counsel would further contend that the petitioner is ready to abide by any condition imposed by this Court. Hence, he prayed for granting bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent would submit that the petitioner has got 5 previous cases and he was remanded to judicial custody only on 02.02.2026 and the investigation is still pending. Hence, he opposed the bail to the petiioner.

5. I have given anxious consideration to the submission of the learned Government Advocate (Crl. Side).

6. Considering the submission of the learned counsel on either side, it is seen that the petitioner was found in the possession of 100 tablets of Nitrazepam. Taking into consideration the criminal antecedents of the petitioner

and the pendency of investigation, this Court is not inclined to enlarge the petitioner on bail.
