ORDER

The petitioners apprehend arrest for the alleged offence under Sections 296(b), 115(2) 118(1), 303(1) of BNS, in Crime No.75 of 2026 on the file of the respondent police seeks anticipatory bail. 1/4

2. The allegation against the petitioners is that the petitioners under the influence of alcohol had attacked the defacto complainant and caused severe head injuries and also robbed 3 1⁄2 sovereign of gold chain. Hence. The case.

3. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. He would further submit that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court and hence, he prays for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side) would reiterate the prosecution and submit that the stolen chain is yet to be recovered. Hence, he opposed for grant of bail to the petitioners.

5. Considering the fact that stolen chain is yet to be recovered and since custodial interrogation of the petitioner may require, this Court is of the view that the petitioners does not deserve anticipatory bail.

6. Accordingly, this Criminal Original Petition is dismissed. 25.03.2026 sma 2/4
