O R D E R

The Criminal Original Petition filed to direct the Inspector of Police, Anti-Land Grabbing Cell, Central Crime Branch, Chennai, the 2nd respondent herein to register the petitioner's complaint dated 28.03.2021. 2.The grievance of the petitioner is that a complaint dated 28.03.2021 was sent to the Commissioner of Police, despite cognizable offence is made out and the offence of cheating and grabbing the property of the petitioner. Hence, he had lodged the above said complaint and no action has been taken. He further submits that the petitioner is residing at Virugambakkam. Further the transaction and the negotiation has been taken place in a hotel at T.Nagar, where they exchanged the documents etc.

3.The learned Government Advocate (Crl. Side) appearing for the respondents submitted that no such complaint dated 28.03.2021 has been received by the respondent police. Further from the typed set of papers, it is seen that the complaint is addressed to the Commissioner of Police, Land Grabbing Cell. There is no such post as Commissioner of Police, Land Grabbing Cell and the postal receipt shows that the complaint has been sent to the Commissioner of Police, Land Grabbing Cell. Sending such complaints would not be proper. The Commissioner of Police is heading the Commissionorate. If petitioner forwards the complaint to the concern division they can have acted upon. Now the complaint is not traceable at the office of the Commission of Police. If the petitioner files a fresh complaint before the respondent police the same would be considered and action can be taken.

4.In view of the same, the petitioner is directed to submit a fresh copy of the complaint in person to the concern officials and on receipt of the same, the respondent police is directed to consider the same and to act upon. 3/5

5.With the above directions, this Criminal Original Petition stands disposed of.
