Respondents/Defendants Prayer:- This Appeal suit has been filed under Section 96 of CPC read with Order 41 Rule 1 of CPC to set aside the judgment and decree dated 09.7.2010 and made in O.S.No.21 of 2009 on the file of the Additional Distrirct Judge, Puducherry at Karaikkal and decree the suit in O.S.No.26 of 2009 for specific performance as prayed for.

J U D G M E N T

It is represented that the matter has been settled between the parties and a joint memo of compromise to that effect has also been filed by the appellant and the respondents.

2. In view of the joint memo of compromise filed by the parties, the Appeal suit is disposed of. The joint memo of compromise shall form part of the judgment. No costs.

3. The learned counsel for the appellant has relied on a judgment in the case of Venkatachalam and others vs. Sengoda Gounder and others, reported in 2014 (6) CTC 216, and seeks for refund of the entire Court fee paid for which the learned https://hcservices.ecourts.gov.in/hcservices/

counsel for the respondents has no objection. Accordingly, the entire court fee is directed to be refunded to the appellant. Connected MP closed.
