ORDER

The petitioner herein had filed a petition before the Judicial Magistrate to register the complaint against Lalitha and others for offence of unlawful assembly, forgery and cheating using forged documents. Since the complaint was not investigated despite the 1/4

direction of the Judicial Magistrate-II, Panruti, the petitioner approached this Court by way of a petition for Mandamus in Crl.O.P.No.9328 of 2024.

This Court, after perusing the records found that in Crime No.548 of 2022 dated 16.12.2022 registered at the instance of the Judicial Magistrate, not been progressed, directed the respondent police to complete the investigation and file a final report within a period of two months. Though the order passed on 18.04.2024, the respondent police had failed to file the final report within time mentioned, the present Contempt Petition moved by the complainant.

The respondent police have filed an affidavit stating that after taking up the investigation pursuant to the direction of this Court, the material collected led to an alteration of the offences from Sections 147, 467, 471 IPC into Sections 467, 471, 120(b), 423, 465, 468 IPC. On completion of investigation, the final report filed through efiling on 30.05.2025. The learned Judicial Magistrate-II, Panruti has taken the case on file and assigned C.C.No.434 of 2025 on 24.07.2025 and had posted the case to 12.09.2025 for completion of service on the 2/4

accused persons.

In the affidavit, the Investigating Officer has tendered an unconditional apology for the delay in completing the investigation. 5.

Recording the fact that the investigation has been completed and the case has reached the stage of trial, the apology tendered by the respondent police is accepted. Accordingly, this Contempt Petition stands closed.
