ORDER
The petitioner, who had jumped bail, had been absconding for a period of nearly five months. A non-bailable warrant was issued against him on 01.03.2025 and he surrendered before the Court on 18.08.2025.
2. The learned counsel for the petitioner would submit that the nonbailable warrant was issued as he could not appear before the Court due to compelling reasons. However, he surrendered before the Court on 18.08.2025 and has been in custody for more than seven months. It is further submitted that the petitioner will hereafter appear before the Court regularly and cooperate with the trial for its early disposal. Hence, he prayed for the grant of bail.
3. The learned Government Advocate (Crl. Side) appearing for the respondent has not seriously opposed the said contention and submitted that 19 witnesses have already been examined and only 2 witnesses remain to be examined after the arrest of the petitioner. It is further submitted that the petitioner has no bad antecedents and that he voluntarily surrendered before the Court on 18.08.2025.
4. I have given anxious consideration to the submissions made by the learned counsel on either side.

In the above circumstances, keeping the petitioner in custody when the trial is nearing completion would prejudice his liberty, especially when a substantial number of witnesses have already been examined. Hence, this Court is of the view that this is a fit case to enlarge the petitioner on bail, subject to certain conditions.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.7, Coimbatore, and subject to the following conditions: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the learned V Additional District and Sessions Judge, Coimbatore everyday at 10.30 a.m. until further orders;
[c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] on breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions had been imposed and the petitioners released on bail by the learned Magistrate/Trial Court itself, as laid down
by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[f] if the petitioner thereafter abscond, a fresh FIR may be registered under Section 269 of the Bharatiya Nyaya Sanhita, 2023.
