..Respondents Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the respondents, particularly the respondents 2 to 4 to consider the petitioner's representation dated 20.10.2014 sent for extension of time to run the canteen at the Combined Namakkal District Court Campus, Namakkal or permit to participate in the tender in case of any fresh tender that would be called for by the respondents. ORDER
Heard Mr.R.Thanjan, learned counsel for the petitioner and Mr.V.Jayaprakash Narayanan, learned Special Government Pleader appearing for the respondents.
2. The petitioner seeks for a direction to respondents 2 to 4 to consider the petitioner's representation dated 20.10.2014 and grant for extension of time to run the canteen at the Combined Namakkal District Court Campus, Namakkal.
3. Admittedly, the petitioner's licence for running the canteen at the Combined Court Campus, Namakkal was only extended till 2013 and it is submitted by the learned Special Government Pleader that subsequently, that building was demolished and the petitioner was also evicted from the premises. Therefore, the question of extending the lease period does not arise. Accordingly, this portion of the prayer sought for by the petitioner is rejected and the writ petition is dismissed.
4. The second limb of the prayer sought for by the petitioner is to permit him to participate in the tender in case of any fresh tender that may be called for by the respondents. For this, there is no necessity for this Court to issue such a direction. As and when the respondent-Department call for a fresh tender and if the petitioner is not disqualified for any other reason, then it is always open to the petitioner to participate in the tender and offer his bid.
5. With the above observation, this writ petition is dismissed. No costs.
