ORDER

The Order of Suspension dated 02.04.2024 bearing reference: R.C.No.11684/D4/2020-2 passed by the second respondent is under challenge in the present writ petition.

2. The case of the petitioner is that the petitioner was suspended both in contemplation of disciplinary enquiry as well as for his involvement in a criminal case.

3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. He further submits that the petitioner name itself does not find place in the FIR nor in the Charge Sheet filed by the CBI.

However, it can be seen that earlier when the petitioner had challenged the Charge Memorandum by way of a writ petition in W.P.No.6572 of 2024 dated 13.03.2024, the same was dismissed by this Court with a direction to the respondents to complete the enquiry within a period of twelve (12) weeks thereafter.

5. In view thereof, even though the learned counsel for the petitioner submits that the suspension of the petitioner is unnecessary, no legal ground is made out by the learned counsel for the petitioner for contending the same. This writ petition is therefore, liable to be dismissed in the light of the order passed by this Court dated 13.03.2024 in W.P.No.6572 of 2024 and is accordingly dismissed. No costs. Consequently, connected miscellaneous petition is closed.
