Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to refund the MBBS degree Course fees of Rs.44,39,300 to the petitioner along with Rs.50,00,000 towards compensation for the damages and injury caused to the petitioner by the respondents by not permitting him to complete his MBBS Degree course with interest accrued at the rate of 12% per annum within a stipulated time.

O R D E R

Heard the learned counsel appearing for the petitioner. Since this Court is not inclined to pass any adverse order as against the respondents, notice to the respondents is dispensed with. 2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents to refund the MBBS Degree Course fees of Rs.44,39,300/- to the petitioner along with Rs.50,00,000/- towards compensation for the damages and injury caused to the petitioner by the respondents by not permitting him to complete his MBBS Degree course with interest accrued at the rate of 12% per annum within a stipulated time.

3.The learned counsel appearing for the petitioner submitted that the petitioner joined the MBBS Degree Course during the year 2011 and paid the entire fees as demanded by the respondents, however, he was not permitted to write the examinations from the second year and hence, he issued legal notice dated 24.08.2023 to the respondents seeking refund of Rs.44,39,300/- along with interest at 2/4

the rate of 12% per annum from the date of payment, however, there is no response. Hence, this Court may without going into the merits of the case, permit the petitioner to make representation to the first respondent in this regard and issue direction to the first respondent to consider the same and to pass appropriate orders, within a reasonable time frame.

4.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, permits the petitioner to make representation to the first respondent, within a period of two weeks from the date of receipt of a copy of this order. If the petitioner makes any such representation, the first respondent shall consider the same, on merits and in accordance with law and pass appropriate orders, within a period of six weeks thereafter. 5.The writ petition is disposed of.
