Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the first respondent to consider the petitioner's representation dated 04.01.2017 requesting for fixation of the petitioner's pay on par with his junior, Mr.R.Ravi in the light of the orders passed in W.P.Nos.3698, 3699, 3700 and 4352 of 2007 dated 18.06.2012 and pass appropriate orders thereon within a time limit to be fixed by this Hon'ble Court.

ORDER

The petitioner retired as Headmaster from the Panchayat Union Middle School, Ravuthampatti, Kandhili Block, Tirupathur Taluk, Vellore District with effect from 29.2.2016. He was awarded incentive increment for acquiring higher qualification of B.Ed., on 7.1.96 and also the further incentive increment for acquiring higher qualification of M.A.,M.Ed., on 26.5.97. Similarly, the third respondent, being junior to the petitioner, was also given incentive increment for acquiring B.Ed., qualificaiton on 24.5.94 and another incentive increment for acquiring M.A.,M.Ed., qualificaiton on 29.5.2010. Since the petitioner's junior, who was also given incentive increment for acquiring M.A.,M.Ed., got the benefit in the revised scale of https://hcservices.ecourts.gov.in/hcservices/

pay, the petitioner has given a representation on 4.1.2017 to step up his pay. Since the said representation has not been considered, he has come to this Court.

2. Mr.P.Sanjai Gandhi, learned Additional Government Pleader, taking notice on behalf of the respondents 1 & 2, sought eight weeks time to consider the petitioner's representation.

3. This Court hereby directs the first respondent to consider the representation of the petitioner on merits and pass appropriate orders in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
