Complaint against the accused persons running school rented the cars from the complainant but failed to pay the rent or returned the car. Alleging that there is no proper investigation, five of the victims joined together and filed Writ Petition seeing transfer of investigation.

2. On notice, the learned Government Advocate (Crl.Side) appearing for the respondents 1 and 2 submits that the complaint received from the victims in respect of 17 cars, out of which, so far 16 cars recovered and only one car which belongs to the second respondent herein yet to be recovered. He would further submit that the investigation is done properly and the remaining cars also will be recovered soon and final report will be filed. He therefore submits that there is no necessity to transfer the investigation since the investigation is done in the right direction.

3. Taking note of the fact that due to proper investigation, out of 17 cars, 16 cars already been recovered, this court finds that there is no 2/4

necessity to transfer the investigation at this stage. Hence, this petition is disposed of in view of the progress made by the Investigation Officer in the complaint. Consequently, connected miscellaneous petition is closed. No costs.
