The application No. 2665 of 2024 has been filed seeking to condone the delay of 63 days in filing the written statement of D1 and D3 and the adoption memo of D2. The application No. 2666 of 2024 has been filed seeking to condone the delay of 20 days in filing the adoption memo of the D4.

2. In the affidavit filed in support of the judges summon, it had been stated that owing to the floods, as the man power was busy in telecasting the same in the news channels, the written statement could not be filed within the stipulated period. The defendants were also not in a position to gather the records to give instructions to file a written statement.

3. Heard the learned counsel for the plaintiff also.

4. Taking all factors into consideration, application Nos. 2665 and 2666 of 2024 stand allowed. Registry to take on file the written statement of the first defendant and adoption memo of the D2, D3 and D4.

5. List the matter under the caption 'for framing of issues' on 05.08.2024.
