A.No.2149 of 2024 in C.S.No.243 of 2023 C.V.KARTHIKEYAN, J This application has been filed by the defendants seeking to set aside an order setting them ex-parte in the application on 10.01.2024 and in the suit on 19.03.2024.

2. The learned Single Judge had observed that despite service of notice and the name being printed in the cause list, there was no appearance on behalf of the applicants herein and after making the interim order absolute, set them ex-parte.

3.Now the application had been filed and in the affidavit filed in support of the Judge's summons, it had been stated that in December 2023, there was a heavy floods in and around Chennai and therefore, the defendants were engaged in gathering news about the flood situation and to telecast the same in the news channel.

4.A counter has been filed by the plaintiff and in the counter, the reasons has been disputed and contested.

5.But however, to express bonafide, the applicants herein had also filed their written statement.

6.In view of that particular fact, this Application stands allowed and the order dated 19.03.2024 setting these applicants ex-parte in the suit is set aside.

7.The Registry may bring on record the application filed with respect to the written statement.
