Respondents Writ Petition filed under Article 226 of the Constitution of India seeking writ of Mandamus directing the respondents to appoint the petitioner on compassionate grounds in any suitable post befitting to his educational qualification pursuant to the enquiry conducted by the third respondent on 06.02.2012. ORDER

By consent, this writ petition is taken up for final disposal at the admission stage itself.

2. The father of the petitioner was a Deputy Tahsildar. He died on 14.12.2006. The mother of the petitioner submitted an application on 16.11.2007 seeking to give employment to any one of the members of the family on compassionate grounds.

3. The 2nd respondent issued a proceeding dated 28.06.2010 to the 3rd respondent to give a report with all records relating to the claim for compassionate appointment. Based on the same, the 3rd respondent directed the petitioner to appear for enquiry on 06.02.2012 by his letter dated 31.01.2012.

4. However, so far no order is passed by the 3rd respondent giving compassionate appointment. Hence, the petitioner made a representation dated 04.10.2012 to the 2nd respondent.

5. In the circumstances, this writ petition is disposed of directing the 2nd respondent to pass orders relating to the claim of the petitioner for compassionate appointment within a period of eight weeks from the date of receipt of a copy of this order, taking into account the aforesaid facts on merits and in accordance with law. No costs.
