The Application has been filed by the defendant in the suit seeking to condone the delay of 46 days in filing the written statement.

2. The suit summons were served on the defendant on 08.01.2020. The written statement had to be filed on or before 07.02.2020, however the written statement has been filed with the delay of 46 days.

3. In the affidavit, it is stated that the Officer of the Legal Department, Mr.Harishankar Venkatraman had resigned from service and relieved on 20.01.2020 and thereafter, the new officer took some time to examine the files and prepare a written statement in the midst of the compulsory lockdown from May 2020 and therefore the written statement could not be signed and presented before this Court within the period mandated.

4. Heard, the learned counsel for the plaintiff.

5. In view of the reasons stated in the affidavit, the application is allowed. Written submission is taken on file. List the matter for filing of affidavit regarding the Admission/Denial of documents on 07.09.2020. http://www.judis.nic.in
