O R D E R
(The case has been heard through video conference) The petitioners, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147,148,294 (b), 323, 307, 506( 2 ) IPC, in Crime No.595 of 2020, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution that due to the previous enmity regarding financial dispute the petitioners along with other accused assaulted defacto complainant and caused head injury. Hence the complaint.
3. The learned counsel appearing for the petitioner would submit that the petitioners are innocent and they have been falsely implicated in this case due to financial dispute. He would further submit that as far as the averments against these petitioners are concerned they have stated they have assaulted the injured with hands and legs and the injured was discharged from hospital. Hence, he prayed for grant of anticipatory bail to the petitioners. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Additional Public Prosecutor appearing for the respondent would vehemently opposed the incident. He would further submit that the petitioners along with the other accused assaulted defacto complainant and caused head injury. The injured discharged from hospital due to Covid-19 and still taking treatment. He would also submit that first petitioner has there previous cases and he is a history sheeter and the arrested accused are still in custody. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioners.
5.Taking into consideration the facts of the case and the submissions made by either side counsel, this Court is not inclined to grant anticipatory bail to the petitioners at this stage. Accordingly, the Criminal Original Petition stands dismissed for the present.
