[Order of the Court was made by Dr.G.JAYACHANDRAN,J.] The assessee, having lost his writ petition challenging the order of the Principal Commissioner of Customs denying his claim for duty drawback, is before this Court seeking leave to condone a delay of 70 days in preferring the intraCourt appeal and to canvass the case on merits.

2. Considering the nature of the dispute and the issue involved, we are inclined to condone the delay in filing the present Writ Appeal. Accordingly, the petition seeking condonation of delay of 70 days is allowed.
