The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 24(1) of COTP Act, 2003 and 328 IPC in Crime Nos.138 and 136 of 2024, seeks anticipatory bail.

2(i).The case of the prosecution in Crl.O.P.No.8776 of 2024 is that the petitioner was found in illegal possession of 122 kgs of banned tobacco products.

2(ii).The case of the prosecution in Crl.O.P.No.8778 of 2024 is that the petitioner was found in illegal possession of 98 kgs of banned tobacco products.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and based on the confession of A1, he has been falsely implicated in this case.

4.The learned Government Advocate (crl.side) appearing for the respondent Police would submit that there is one previous case of similar in nature against the petitioner and the quantity of contraband https://www.mhc.tn.gov.in/judis

vkr involved is commercial in nature. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent and perused the materials available on record.
